We invite you to endorse the UDPM

Adopting the Protocol as an individual mediator

Any mediator, regardless of affiliation, can pledge to use the Protocol as a guide to disclosure to her or his parties. Adopting the Protocol does not require that the mediator be bound to any process but does require that the mediator will discuss the List of elements for disclosure and any relevant optional topics with parties as part of intake and mediation.

Adopting the Protocol as individual counsel

Any counsel, regardless of affiliation, can pledge to use the Protocol as a starting point to choose a mediator. Counsel who adopt this protocol declare that they would give preference to a mediator that signed this protocol rather than one that did not endorse this protocol.

ADOPTING THE PROTOCOL AS A MEDIATION ORGANIZATION

Any mediation organization, regardless of affiliation, can pledge to use the Protocol as a guide to disclosure. Adopting the Protocol does not require the organization to be bound to any mediation process but does require that the organization agrees with the List of elements for disclosure.

ADOPTING THE PROTOCOL AS A ORGANIZATION

Any organization (chamber of commerce, university, training organization, mediation centres) regardless of affiliation, can pledge to use the Protocol as a guide to disclosure for a mediator. Adopting the Protocol does not require the organization to be bound to any mediation process but does require that the organization agrees with the List of elements for disclosure.

For mediators:

Wording for possible inclusion in a mediator’s administrative or contractual paperwork:

“Universal Disclosure Protocol for Mediation (UDPM)

[x organisation and] the mediator is/are (a) supporter(s) of and signatory(ies) to the Universal Disclosure Protocol for Mediation (UDPM) .

I/We have committed to discuss the List of elements for disclosure and any relevant optional topics with parties as part of intake and mediation in which I/we are involved.

I/We are also committed to encouraging those with whom we mediate similarly to give preference to a mediator that signed this Universal Disclosure Protocol for Mediation.

The full pledge is also included in [x/my] [Terms of Engagement which are attached to our draft Agreement to Mediate]. I/We invite the parties to give consideration to the Pledge.”

For counsels:

Wording for possible inclusion in a counsel website or information:

“Universal Disclosure Protocol for Mediation (UDPM)

[x organisation and] the counsel is/are (a) supporter(s) of and signatory(ies) to the Universal Disclosure Protocol for Mediation (UDPM).

I/We have committed to use the Protocol as a starting point to choose a mediator. I/We declare that I/We would give preference to a mediator that signed this protocol rather than one that did not endorse this protocol.

I/We are also committed to encouraging those with whom are in mediation to similarly give preference to a mediator that signed this Universal Disclosure Protocol for Mediation.

[NAME OF YOUR ORGANISATION] are proud to be supporting the Universal Disclosure Protocol for Mediation (UDPM), officially launched today.

Mediators have a special role to play in framing the multitude of mediation modes by following a practical tool of disclosure elements, to be used by any mediator anywhere.

The Pledge may be viewed www.udpm.org website, and individuals (mediators, counsels, users) are invited to consider their practice and sign the pledge.
